The Food Safety and Standards Authority of India (FSSAI) has proposed a comprehensive nationwide restriction on the manufacture, distribution, and sale of non-dairy analogue items marketed as "paneer". The apex food regulator has issued draft amendments to the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, aimed at eliminating deceptive labelling and standardizing enforcement across the country.

Under the proposed Food Safety and Standards (Prohibition and Restrictions on Sales) Amendment Regulations, 2026, manufacturers operating under the "Analogue in Dairy Context" licensing category will be strictly prohibited from using the term "paneer" in their product names, packaging, advertising, or marketing materials. The draft rules mandate that only products exclusively derived from milk and milk solids can bear the traditional name.

The regulator has opened a 60-day public consultation window from the date of the gazette notification to invite feedback, suggestions, and objections before formalizing the rules.

Clampdown on Imitation Dairy

Traditional paneer is produced exclusively by curdling whole milk, but non-dairy analogues have rapidly penetrated the market by substituting butterfat with cheaper refined palm oil, hydrogenated fats, skimmed milk powder, modified starches, and synthetic emulsifiers. While compliant food analogues can legally exist as separate plant-based or composite products, businesses have routinely labelled and sold them as pure paneer at significantly lower price points.

The FSSAI's draft notification follows fragmented state-level enforcement measures taken in recent months:

• Maharashtra enacted a one-year ban on the production, distribution, and sale of imitation analogue paneer following laboratory test failures.
• Gujarat introduced state-wide prohibitions covering the manufacturing, storage, and transport of analogue paneer, butter, and cheese.
• Karnataka, Madhya Pradesh, and Himachal Pradesh initiated aggressive regulatory crackdowns on misleading dairy substitutes.
• Food aggregator platforms, including Zomato, adopted zero-tolerance policies, removing menu listings that contained non-dairy substitutes disguised as real paneer.

By issuing central draft amendments under Section 92 of the Food Safety and Standards Act, 2006, the central regulator intends to eliminate jurisdictional discrepancies and establish a unified national standard.
